Cause of the San Diego Bicycle Accident

The cause of this fatal February 5th bicycle accident remains under investigation by the San Diego Police Department. Based on the limited information provided in news accounts, it is unclear who was at fault. It is not clear whether the bicycle was riding on the shoulder or in traffic lanes when he was struck. It is also unclear if the truck driver was speeding. Hopefully the investigation by law enforcement will reveal answers to the many unanswered questions raised after this accident.

Bicycle Accident Wrongful Death Liability

If police determine that the truck driver was responsible for this accident, the driver may be liable for the wrongful death of the cyclist. In the event the driver of the truck was "on the job" at the time of the accident, the truck driver's employer - and other parties as well - may be liable for the accident. After a fatal truck accident such as this one, the family members of the victim would be well-advised to speak with a California truck accident wrongful death lawyer about the accident and the family's legal rights and options. An attorney can also evaluate whether a dangerous road condition may have contributed to the accident, in which case the agency responsible for the design and maintenance of the roadway could be liable.
